Welcome to magicmatrimony.com(a division of shaadibiye), a Matrimonial Services Provider. To use the shaadibiye site, all you need to do is register as a member of the site and agree to abide by our Terms of Use. Once you become a member of our site, you would be able to communicate with other members of our site and make use of the services of shaadibiye.
So, go through these Terms of Use and then fill up the Registration form for membership following the directions stated. As of now, this membership is free of charge. This Agreement, which is legally binding for your membership, may be modified by shaadibiye from time to time, of which you, as a member, would be notified via e-mail. |

1. to be eligible… |

To register as a member of shaadibiye or to use this site, you must be of legal marriageable age as per the Indian laws (minimum 18 years for females and 21 for males). Membership in the service is invalid where prohibited. By using this site, you manifest and affirm that you have the right, authority, and capacity to enter into this Agreement and be bound to all its terms and conditions. |

2. regarding membership…

As an inaugural offer, we provide a limited number of free memberships to our site. You can become our free member and remain so as long as our membership rules do not change. If you want to terminate your membership at any time, for any reason, do so by writing to shaadibiye. On the other hand, we may terminate your access to the site and/or your membership for any reason, notifying you of the same via e-mail. |

3. our proprietary rights… |

shaadibiye owns as well as retains other proprietary rights of the shaadibiye site and the shaadibiye service. The site contains the copyrighted material, trademarks, and other proprietary information of shaadibiye, and its licensors. Except for that information which is in the public domain or for which you have been given permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

The shaadibiye site is for the personal use of its individual members only, and may not be used for any commercial purposes including providing links to other web sites. No organization, company, and/or any business can become members of our site nor use the shaadibiye service or site for any purpose. In case of any illegal and/or unauthorized use of the site, including unauthorized framing of or linking to the site, an investigation will be carried out, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

shaadibiye does not allow any member to have more than one profile.
We prohibit our members from advertising or soliciting other members to buy or sell any product or service through our service. You are disallowed to transmit any chain letters or junk e-mail to other members of shaadibiye. Though it’s not possible for us to monitor the conduct of the members of our site, it is against these rules to use any information obtained from the service in order to harass, abuse, or harm another person, or in order to contact, advertise, solicit, or sell to any member without their prior permission. In order to safeguard shaadibiye and/or our members from any abuse or misuse, we reserve the right to check the number of communications , profile contacts , responses & e-mail which a member may send to another member in any 24-hour period to a number which shaadibiye considers justified in its sole discretion.

6. regarding the content… |

You are solely responsible for the content that you publish or display on our site, or transmit to other shaadibiye members. We reserve the right to verify the authenticity of the content posted on our site. To accomplish this right, shaadibiye may ask you to produce any documentary proof in support of the content you have posted on the site. If you fail to comply, shaadibiye may, in its sole discretion, terminate your membership.
shaadibiye holds the right to erase any content, message, photograph or profile that it deems to violate the Terms of Use or which might be objectionable and illegal, or that might violate the rights, harm, or threaten the safety of its other members.
By posting content on any public area of shaadibiye, you automatically manifest and confirm that you grant shaadibiye and its members an unalterable, perpetual, non-exclusive, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the same.
The following is a partial list of the kind of content that is illegal or prohibited on the site. shaadibiye will investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the service and terminating the membership of such violators. It includes content that:
is blatantly offensive to the online community, promoting racism, bigotry , hatred or physical harm of any kind against any group or individual;
harasses or advocates harassment of another person;
is false and misleading or promotes unlawful activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
displays pornographic or sexually explicit material of any kind;
provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to such files;
provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page) ; and
engages in commercial activities and/or sales without our prior written permission.

7. regarding member disputes… |
|
As far as interactions with other shaadibiye members are concerned, you are the one solely responsible for it. shaadibiye reserves the right, but has no obligation, to monitor disputes between you and other members. We also hold the right, without being obliged, to take appropriate action against errant members.

8. regarding disputes… |
|
If there is any dispute about or involving the site and/or the service, the dispute will be governed by the laws of the state of West Bengal, India without regard to its conflict of law provisions. The personal jurisdiction would be carried out in the state and central courts of Kolkata, India.

9. regarding indemnity… |
|
nce a member, you agree to indemnify and hold shaadibiye, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above.

You are not permitted to reproduce, distribute, or post in any way any copyrighted material, trademarks, or other proprietary information available on shaadibiye without obtaining a prior written consent from us.

11. limitation on liability… |
|
Except in jurisdictions where such provisions are restricted, under no circumstances shall shaadibiye be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punishable damages, which includes loss of profits arising from your use of our site or service, even if shaadibiye has been advised of the possibility of such damages.

shaadibiye is not responsible for any incorrect content posted on the site or in connection with our service, whether caused by users, members or by any of the equipment or programming associated with or utilized in the service, nor for the conduct of any user and/or member of the shaadibiye service whether online or offline. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of user and/or member communications. In case of any problem or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or members or to any other person's computer related to or resulting from participating or downloading materials in connection with the shaadibiye site and/or service, we are not responsible for the same. Under no circumstances will shaadibiye be responsible for any loss or damage resulting from anyone's use of the site or the service and/or any content posted on the site or transmitted to its members.

a. By becoming a member of the shaadibiye service, you agree to receive certain specific e-mail from shaadibiye.
b. You must use the shaadibiye service in accordance with any and all applicable local, state, and national laws and regulations.
c. You may not include in your member profile, visible to other members, any telephone numbers, street addresses, last names, URL's, and e-mail addresses.
d. This Agreement, accepted upon use of the site and further affirmed by becoming a member of the shaadibiye service, contains the entire agreement between you and shaadibiye regarding the use of the site and its service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue to be effective.
By joining shaadibiye, you confirm that you have read the above provisions and agree to abide by them.
